1. Scope of Application
These Terms and Conditions apply to all orders placed via our online shop (equosaurora.com). Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with: EQUOS AURORA e.U.
The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalogue. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided during the ordering process. By clicking the order button, you submit a binding offer for the goods contained in the shopping cart.
Confirmation of receipt of your order is sent immediately by email after submission. We accept your offer within two days by either sending a separate order confirmation email or by processing the payment transaction through our service provider or your selected payment provider. The contract is concluded depending on which of these alternatives occurs first.
3. Contract Language, Storage of Contract Text
The languages available for the conclusion of the contract are German and English. The contract text is not stored by us. We recommend saving your order details immediately after completing your purchase.
4. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal pursuant to Section 11 et seq. of the Austrian Distance and Off-Premises Contracts Act (FAGG). You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day on which you or a third party designated by you takes possession of the goods. To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. letter or email). To meet the deadline, it is sufficient that you send your notification before the withdrawal period has expired.
Consequences of Withdrawal:
If the entire order is returned, we will refund all payments received, including delivery costs, less any applicable handling fee(s), within 14 days. If only part of the order is returned, delivery costs cannot be refunded. If, as a result of a partial withdrawal, the value of the retained goods falls below the threshold required for free shipping, the originally waived shipping costs will be charged retrospectively. Shipping costs, as well as handling fee(s), will be offset against the refund of the purchase price.
Refunds will be made using the same payment method used for the original transaction. The customer bears the direct costs of returning the goods and any handling fees.
The goods must be returned in their original condition (including velvet pouch, etc.) and in the original packaging. Tags must not be removed, the product must be unworn and clean, and must show no signs of use. As a general rule, products may only be tested to the extent that would be possible in a retail store.
If hair or other contamination is found on the product, a handling fee of €9.95 will be charged in any case. Depending on the time required to process a return with hair or other contamination, the handling fee may be higher. The handling fee of €9.95 applies per 30 minutes (per 0.5 hour of processing time). The amount will also be deducted from the refund.
If a return is rejected by our returns department because it does not comply with the return conditions, you remain obliged to purchase the item. The item will be returned to you subject to a handling fee of €7.95. We will contact you so the matter can be resolved within three months. If no response is received within this period, non-accepted returned items will be disposed of. We assume no responsibility for the short-term storage of non-accepted returned goods.

5. Prices and Payment Terms
The prices stated on the product pages include statutory VAT for customers within the European Union.
The following payment methods are generally available:
Visa, Mastercard, American Express, Maestro, Bancontact, iDEAL, eps, bank transfer, PayPal, Apple Pay / Google Pay.
6. Delivery and Shipping
We deliver worldwide by shipping. Collection in person is only possible in Austria/Tyrol.
Further details regarding shipping costs, return costs, handling fees, and possible delivery restrictions can be found in our FAQs. The customer bears all return costs unless the return is due to defective goods. In the event of delivery delays, we will inform you without undue delay.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Transport Damage
If goods are delivered with obvious transport damage, please report such defects immediately to the delivery agent and contact us without delay. Failure to make a complaint or to contact us has no effect on your statutory claims, but helps us assert our own claims against the carrier or transport insurer.
9. Warranty and Liability
Statutory warranty rights apply. We are liable without limitation for claims arising from damages caused by us, our legal representatives, or agents:
– in the event of injury to life, body, or health,
– in cases of intentional or grossly negligent breach of duty,
– in the event of agreed guarantees,
– and for claims under the Austrian Product Liability Act.
In the case of slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract at the time of its conclusion. Otherwise, claims for damages are excluded.
10. Applicable Law and Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers residing in the EU, this choice of law applies only insofar as mandatory provisions of the law of their country of residence are not overridden. The place of jurisdiction for all disputes is the registered office of EQUOS AURORA, unless mandatory consumer jurisdiction applies.
11. Online Dispute Resolution

12. Final Provisions
Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
